The Court of Appeal of Milan established that in some cases the basic pay paid by the national carrier ITA Airways was "illegitimate" as it was not "sufficient to ensure a free and dignified existence for oneself and the family", as established by article 36 of the Italian Constitution. The judges thus ruled in favor of the appellants, who protested against the first salaries offered to workers when the company was founded, on 15 October 2021.

That day the company had entered into working relationships with its employees without adhering to the national collective agreement of reference for the sector. It was a company agreement, with minimum wages lower than the standards of the sector, which on 2 December 2021 was signed by the CGIL, CISL, UIL, UGL unions and the professional associations of pilots and flight attendants.

Last January 3, 2024, the judges ruled that those contracts were unconstitutional: the monthly salary was so low as to "be close to the citizen's income, to the absolute poverty threshold according to the Istat indices and is suitable to allow access to legal aid for state costs", wrote the Court of Appeal of Milan in the sentence.
